§ 113.15. FINDING OF NECESSITY.

  • The Council of the Village of Pinckney adopts this subchapter after hearings held on the following determinations made by it:
    (A) There is a possibility of conflict between the operation of filling and/or service stations and public garages as defined in this subchapter and the quiet, peaceful enjoyment of adjacent residential areas;
    (B) The unrestricted and unregulated operation of a service station and/or filling station and public garages, being in large measure an open air land use, in the finding of this Council may constitute a public nuisance and could be detrimental to the general health, welfare and safety of the people of the village;
    (C) The regulation of activities and equipment of filling or service stations and public garages, as herein defined, is necessary to comprise the conflict existing between the operation of the filling or service stations and adjacent residential areas;
    (D) Among other things, the notice, odor, lights, fumes vibration, dust, danger of fire and explosions, traffic problems, incidental to the operation of filling and service stations and public garages are factors peculiar to this business which warrant their being the subject of regulation as set forth in this subchapter;
    (E) Within the village limits of Pinckney, the unregulated and unrestricted operation of service and/or filling stations and public garages constitutes a potential fire hazard and also a potential safety hazard to pedestrians; and
    (F) The Council of the Village of Pinckney has determined after study and hearings, that it is to the benefit of the public to regulate all filling and service stations and public garages operating in the Village of Pinckney, and to establish uniform rules for the location, operating and equipping of same within the Village of Pinckney.
