§ 113.22. NONCONFORMING USES.

  • (A) Nonconforming use permitted.
    (1) Service stations and garages already in existence at the effective date of this subchapter do not need to conform to §§ 113.18 and 113.20 with the following exceptions. All stations, new or pre-existing, must conform with provisions of § 113.20, as follows:
    (a) Section 113.20(E)(7);
    (b) Section 113.20(F)(7);
    (c) Section 113.20(F)(8);
    (d) Section 113.20(G)(4);
    (e) Section 113.20(G)(7); and
    (f) Section 113.20(G)(5).
    (2) In the event that the use of any nonconforming service station or public garage is discontented for a period of one year, or in the event that major alterations shall be required thereto, the privilege for the nonconforming use shall terminate, and the premises shall not thereafter be used for a service station except in conformity with all provisions of this subchapter or approval of Pinckney Village Council.
    (3) All other provisions for governing nonconforming uses, including appeals, shall be as defined and provided for in the Zoning Ordinance and amendments thereto.
    (B) Nonconforming use not permitted.
    (1) A service or public garage in use as such at the time of the effective date of this subchapter shall be brought into compliance with the requirements of this subchapter within 90 days of its adoption, except as provided in division (A) above.
    (2) In the event that a general sign ordinance regulating all signs on, over or adjacent to the village streets is adopted subsequent to the adoption of this subchapter, the provisions of that ordinance supercedes the requirement of this subchapter as pertains to signs.
